Please read these Terms and Conditions (“Terms”, “Agreement”) carefully before making a reservation or staying at any KOMFFY LLC property (“Property”, “we”, “our”, or “us”). By booking a unit, using our website, or staying at our property, you agree to be bound by these Terms and our Privacy Policy.
1. GENERAL TERMS
These Terms govern all reservations, stays, services, and transactions between guests and KOMFFY LLC. They are legally binding upon confirmation of a booking, whether made directly through our website, by phone, email, or through any authorized third-party platform (such as Expedia, Booking.com, Airbnb, etc.).
2. CHECK-IN, CHECK-OUT, AND IDENTIFICATION
Check-in time: 3:00 PM onwards | Check-out time: By 10:00 AM
Early check-in or late check-out is subject to availability and may incur an additional fee.
A valid government-issued photo ID and credit card are required at check-in for verification and security deposit purposes.
Only registered guests may stay overnight. Visitors are allowed only with prior authorization and must comply with property rules.
3. RESERVATIONS, RATES & PAYMENTS
All rates are quoted in U.S. Dollars (USD) and subject to taxes, resort fees, and security deposits as applicable under Florida law.
Full payment or deposit is required to confirm a reservation. Failure to provide payment may result in automatic cancellation.
Rates are based on double occupancy unless otherwise stated. Additional guests may incur extra charges.
Accepted payment methods: Visa, MasterCard, American Express, Discover, and approved digital/ACH methods.
Incidental Hold: A refundable hold may be placed on your credit card at check-in to cover damages, missing items, or violations of these Terms.
4. CANCELLATIONS, MODIFICATIONS & NO-SHOW POLICY
Cancellations and modifications must be made within the timeframe stated on your booking confirmation.
Late cancellations or no-shows will incur a charge equal to the first night’s stay plus tax (or as specified in your booking).
Non-refundable reservations cannot be canceled or modified once confirmed.
No refunds will be provided for early departures, unused nights, or interruptions due to weather or unforeseen events.
5. GUEST RESPONSIBILITIES & CONDUCT
Guests agree to:
Respect all property rules, staff instructions, and posted signage.
Maintain cleanliness and care of the unit, room, and common areas.
Refrain from loud noise, parties, or disturbances that affect other guests.
Avoid smoking inside rooms or buildings (a $250 cleaning fee applies for violations).
Use property facilities responsibly and for their intended purpose only.
Not engage in illegal activities, harassment, or unsafe behavior.
KOMFFY LLC reserves the right to evict guests without refund for behavior deemed dangerous, disruptive, or in violation of these Terms.
6. DAMAGE, LOSS, AND SECURITY DEPOSIT
Guests are financially responsible for any damage, breakage, theft, or loss caused during their stay.
KOMFFY LLC may charge the cost of repair, replacement, or additional cleaning directly to the credit card on file.
Missing towels, linens, or room accessories will be charged at replacement value.
KOMFFY LLC is not responsible for loss or theft of personal items left in rooms, units, vehicles, or public areas. A safe deposit box may be available upon request.
7. SMOKING, ALCOHOL & PETS
No smoking is permitted inside rooms, units, or indoor areas of the building.
Alcohol consumption is permitted only in designated areas and must comply with Florida’s legal drinking age (21+).
Pets: Only service animals are allowed unless otherwise pre-approved. Unauthorized pets may result in a $200 cleaning fee.
8. LIABILITY DISCLAIMER
To the fullest extent permitted by law:
KOMFFY LLC, its owners, and affiliates are not liable for any injury, accident, loss, theft, damage, or expenses incurred during your stay, whether in rooms, units, common areas, or parking lots.
The use of property amenities, including pool areas and common facilities, is at the guest’s own risk.
Guests waive any claims against KOMFFY LLC for injuries or damages arising from negligence, acts of God, or third-party actions.
9. FORCE MAJEURE
KOMFFY LLC shall not be held liable or responsible for delays, cancellations, or inability to perform obligations due to events beyond its reasonable control, including but not limited to natural disasters, pandemics, strikes, power outages, government restrictions, or acts of war.
10. PRIVACY & DATA USE
Personal information collected during the reservation or stay is processed in accordance with our Privacy Policy.
By booking, you consent to receive transactional and follow-up communications related to your stay (confirmations, invoices, satisfaction surveys, etc.).
11. MAINTENANCE & ACCESS
KOMFFY LLC reserves the right to enter units or rooms for maintenance, housekeeping, or safety inspections, with or without prior notice, when necessary.
Utilities and amenities may require periodic maintenance; refunds will not be issued for temporary outages.
12. LIMITATION OF LIABILITY
In no event shall KOMFFY LLC’s total liability exceed the total amount paid by the guest for the stay in question.
KOMFFY LLC shall not be liable for any indirect, incidental, or consequential damages arising from your use of our property or website.
13. INDEMNIFICATION
You agree to indemnify and hold harmless KOMFFY LLC and its employees, officers, and contractors from any claims, damages, or losses resulting from your stay, actions, or breach of these Terms.
14. GOVERNING LAW & DISPUTE RESOLUTION
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law principles.
Any dispute shall first be attempted to resolve amicably. If unresolved, the dispute will be submitted to binding arbitration in Broward County, Florida, under the rules of the American Arbitration Association (AAA).
Guests waive any right to a class action or jury trial.
15. AMENDMENTS
KOMFFY LLC reserves the right to modify these Terms at any time without prior notice. Updated Terms will be posted on our website, and continued use of our services constitutes acceptance of the revised version.
